Maryland officials urge action on school safety transfer rule as legislature delays vote

BALTIMOREFollowing lawmakers’ refusal to vote on an emergency ordinance intended to improve communication regarding student safety hazards during school transfers, the Maryland State Board of Education and State Superintendent Dr. Carey M. Wright voiced concerns Thursday.

The State Board recommended the regulation during its October 22 meeting, and the Joint Committee on Administrative, Executive, and Legislative Review (AELR) delayed its decision. The rule aims to close a gap in the way school districts communicate information on pupils who have committed reportable offenses.


When a student switches schools, school administrators are required by Dr. Wright’s current guidance to disclose confidentially records of reportable infractions. This rule is applicable retrospectively to children who have been enrolled since the beginning of the 2023–2024 school year. While the proposal is undergoing the regulatory review process and public comments are being received by the Maryland State Department of Education (MSDE), the guidance will continue to be in effect.

In order to enhance safety measures, the State Board underlined the value of working together with legislators and organizations, such as the Department of Juvenile Services. In a joint statement, the officials stated, “We believe district leadership must have the necessary information to determine the most appropriate setting when an individual student presents a safety risk in order to ensure the safety of all members of the school community.”

Although no timetable for action has been established, it is anticipated that the General Assembly will review the issue during its upcoming legislative session.
