According to a proposed law in New Jersey, if an undocumented immigrant files for a weapons purchaser identification card (FPIC) or handgun purchase permit (PPH), local law enforcement and the State Police would have to alert federal immigration officials. The goal of the bill is to bring state handgun application processes into compliance with federal immigration regulations.
If a weapon applicant is found to be in the country illegally, law enforcement agencies would be required by the proposed act to alert and assist U.S. Immigration and Customs Enforcement (ICE) and other federal officials. Under 18 U.S.C. 922(d)(5), federal law already forbids the sale or transfer of weapons to undocumented immigrants; the bill would formally enforce state-level adherence to that requirement.
New Jersey already requires a lot of personal information from applicants for guns permits, including fingerprints, mental health records searches, and criminal background checks. The additional clause would require notice to federal authorities in the event that an applicant is determined to be unauthorized and would add an immigration status review for non-citizens.
The bill’s supporters contend that by guaranteeing more stringent control over handgun availability, it improves public safety. “This legislation ensures that firearms do not end up in the hands of individuals who are not legally present in the country and reinforces federal laws already in place,” MPs said in a statement that accompanied the bill.
Concerns over possible overreach and the effect on immigrants who would be deterred from dealing with law enforcement out of fear of deportation have been voiced by critics, including several immigrant advocacy groups. They contend that the action would erode confidence between local government and immigrant communities.
If passed, the bill will further harmonize New Jersey’s gun laws with federal immigration regulations by establishing a state-level enforcement tool to track firearm sales involving non-citizens.
