Ocean County Man Held on Immigration Detainer After Arrest for Burglary and Drug Charges

TOMS RIVER, N.J. Per county jail records, Jos L. Gutierrez-Hernandez, 25, of Ocean County, was arrested on January 10, 2025, and is charged with several counts, including drug-related offenses, burglary, and criminal mischief.

After being arrested, Gutierrez-Hernandez is being detained at the Ocean County Jail. In a second case concerning improper disposal of controlled dangerous chemicals, he faces a $1,000 cash bond, while in a criminal mischief and burglary case, he faces no bail.

Authorities accused Gutierrez-Hernandez of burglary under statute 2C:18-2A(1) and criminal mischief for property damage under statute 2C:17-3A(1). In addition, he is charged with a fourth-degree offense—failing to properly dispose of prohibited narcotics.

A U.S. Immigration and Customs Enforcement (ICE) immigration detainer, which indicates additional legal actions, is also listed in the records.

According to jail documents, Gutierrez-Hernandez also goes by the moniker Luis Hernandez Martinez.
