Lancaster, Pennsylvania According to officials, a 49-year-old man from East Hempfield Township will go on trial in Lancaster County Court for allegedly fatally stabbing a lady and gravely wounding her brother during a violent dispute earlier this month.
On charges of criminal homicide, attempted criminal homicide, aggravated assault, possession of a criminal instrument, and recklessly endangering another person, Benjamin Garcia Gual, who lives in the 2600 block of Scenic Drive, waived his preliminary hearing.
The event happened at a house in Lancaster’s 2900 block of Dell Lane on November 3 at around 1:40 p.m. Carmen and Luis Martinez-Silva, siblings, were discovered by police with several stab wounds. Luis Martinez-Silva survived with stab wounds to his left arm, chest, abdomen, and cranium, while Carmen Martinez-Silva passed away at the site despite first responders’ best efforts to save her life.
Investigators indicated that Garcia Gual’s rage about Carmen Martinez-Silva’s recent haircut was the reason behind the attack, as he threatened her. Police were informed by witnesses that Carmen had spent the previous night at the Dell Lane property because she was afraid of Garcia Gual, with whom she was romantically involved.
When Garcia Gual got to the house and started stabbing Luis Martinez-Silva, the violence started. Carmen was fatally attacked when she tried to step in. Garcia Gual, according to the police, apparently attempted to stab two other people at the site but was unsuccessful.
Garcia Gual was discovered with a kitchen knife inside a car near the site. He is still in detention and is awaiting trial in the Lancaster County Common Pleas Court.
